1. INTRODUCTION

1.1 Welcome to BloodTrack

Welcome to BloodTrack, a digital health platform that helps you track, monitor, and understand your blood test results over time. These Terms and Conditions govern your use of the BloodTrack website and all related services and applications (collectively, the "Platform").

1.2 Acceptance of Terms

By accessing or using the BloodTrack Platform, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you disagree with any part of these terms, you may not access or use our Platform.

1.3 Amendments to Terms

"BloodTrack" refers to the BloodTrack brand and platform operated by Tugadot, including all associated applications and services.

"Healthcare Provider" means any medical practitioner, pathology laboratory, or other healthcare service that a User authorizes to access their data on the BloodTrack Platform.

"User" means any individual who registers for and uses the BloodTrack Platform to track, store, and manage their blood test results and related health information.

"Platform" means the BloodTrack website, mobile applications, and all associated digital services and content.

"Test Results" means any blood test data, pathology reports, or related health information uploaded to or stored within the BloodTrack Platform.

"Analytics" means the analysis, visualization, trend identification, and other data processing performed on Test Results by the BloodTrack Platform.

3. REGISTRATION AND ACCOUNT SECURITY

3.1 Registration Requirements

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify BloodTrack immediately of any unauthorized use of your account or any other breach of security.

3.3 Healthcare Provider Registration

Healthcare Providers must provide additional verification information, including professional credentials and licensing information. BloodTrack reserves the right to verify this information and to refuse or revoke registration if the information provided is inaccurate or insufficient.

4. BLOOD TESTING AND TRACKING SERVICES

4.1 Service Description

BloodTrack provides a digital platform for monitoring, tracking, and managing blood test results and pathology information. The Platform enables Users to store, access, analyze, and share their blood test history securely with authorized Healthcare Providers.

4.2 Role of BloodTrack

BloodTrack is a digital health management tool that helps Users track and understand their blood test results over time. We do not provide medical advice, diagnosis, or treatment. Our Platform offers visualization tools, trend analysis, and educational resources to help Users better understand their blood test data.

4.3 No Medical Advice

While BloodTrack may provide reference ranges, historical comparisons, and educational content about blood tests and biomarkers, this information is for reference purposes only and should not be considered medical advice. Always consult with a qualified healthcare professional for interpretation of your test results and any medical decisions.

5. USER OBLIGATIONS

5.1 General Obligations

As a User of the BloodTrack Platform, you agree to:

  • Comply with all applicable laws and regulations
  • Respect the rights of other Users and third parties
  • Use the Platform only for its intended purposes
  • Not engage in any activity that could harm the Platform or interfere with its operation

5.2 User Obligations

As a User of the BloodTrack Platform, you agree to:

  • Provide accurate personal and health information
  • Ensure you have the necessary rights to upload and store any test results
  • Use the data visualization and analysis tools responsibly
  • Understand that the Platform is a supplementary tool and not a replacement for professional medical advice
  • Maintain the confidentiality of any shared access credentials provided to healthcare professionals

5.3 Healthcare Provider Obligations

As a Healthcare Provider with access to patient data on the BloodTrack Platform, you agree to:

  • Access patient data only with explicit permission from the patient
  • Maintain all necessary licenses, certifications, and insurance
  • Comply with all relevant healthcare regulations and privacy laws
  • Use the information accessed through the Platform in accordance with professional standards
  • Respect patient confidentiality and data security requirements

6. FEES AND PAYMENT

6.1 Fee Structure

BloodTrack offers various subscription plans and service tiers. All fees and subscription details are clearly displayed on our pricing page. Fees may vary based on the selected plan, features accessed, and account type.

6.2 Payment Processing

All payments are processed securely through our Platform. By providing payment information, you authorize BloodTrack to charge the designated payment method for the subscription plan or services you select. For subscription services, you authorize recurring charges according to your selected billing cycle.

6.3 Refunds and Cancellations

You may cancel your subscription at any time through your account settings. Depending on your subscription type, you may continue to have access to the Platform until the end of your current billing cycle. Pro-rated refunds may be available for annual subscriptions as specified in our refund policy. Free trial periods automatically convert to paid subscriptions unless canceled before the trial period ends.

7. PRIVACY AND DATA PROTECTION

7.1 Privacy Commitment

Your privacy is our highest priority. BloodTrack is committed to maintaining the strictest standards of data protection for your sensitive health information. Our complete Privacy Policy is incorporated into these Terms and Conditions by reference and provides detailed information about our data practices.

7.2 Data Ownership and Control

You always maintain ownership of your health data. The information you upload to BloodTrack remains yours, and we act solely as the processor of this information to provide you with visualization, tracking, and analysis services.

7.3 Data Security Measures

We implement industry-leading security measures to protect your personal and health information, including:

  • End-to-end encryption of all health data
  • Secure, encrypted storage on Australian servers
  • Regular security audits and vulnerability testing
  • Strict access controls and authentication protocols

7.4 No Data Selling or Third-Party Sharing

BloodTrack will never sell your data to third parties. Your information is never shared with advertisers, data brokers, or marketing companies. We only process your data to provide you with the services you've explicitly requested.

7.5 AI Processing and Data Protection

If you choose to use our AI-powered analysis features:

  • All AI processing is performed using anonymized data
  • No personally identifiable information is retained by the AI systems
  • Your data is not used to train or improve AI models without your explicit consent
  • You can opt out of AI processing features at any time through your account settings
  • AI-generated insights are provided as educational content only and not as medical advice

7.6 Account Isolation

Your BloodTrack account is completely isolated. We do not link your health data with other services, social media platforms, or third-party applications unless you explicitly authorize such connections.

7.7 Data Retention and Deletion

You can request complete deletion of your data at any time through your account settings. Upon account deletion:

  • All your personal and health data is permanently removed from our systems
  • Backups containing your data are purged according to our deletion schedule (typically within 30 days)
  • Any anonymized statistical data that cannot be traced back to you may be retained

7.8 Transparency and Control

You have complete visibility into how your data is used through:

  • Detailed access logs showing who has viewed your information
  • Granular privacy controls to determine what data is visible to healthcare providers
  • The ability to export your complete data at any time in standard formats

8. INTELLECTUAL PROPERTY

8.1 BloodTrack Intellectual Property

The BloodTrack Platform, including all content, features, and functionality, is owned by Tugadot (Sole Trader) or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from our Platform without explicit permission.

8.2 Limited License

Tugadot grants you a limited, non-exclusive, non-transferable, revocable license to access and use the BloodTrack Platform for its intended purposes in accordance with these Terms and Conditions.

8.3 User Content

You retain ownership of any content you submit to the Platform. By submitting content, you grant Tugadot a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content solely for the purposes of providing and improving the BloodTrack services.

9. LIMITATION OF LIABILITY

9.1 Disclaimer of Warranties

THE BLOODTRACK PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TUGADOT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUGADOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE BLOODTRACK PLATFORM OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.3 Cap on Liability

IN NO EVENT SHALL TUGADOT'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE BLOODTRACK PLATFORM OR SERVICES EXCEED THE AMOUNT PAID BY YOU TO TUGADOT DURING THE THREE (3) MONTHS PRIOR TO THE CLAIM.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Tugadot, its owner, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms and Conditions or your use of the BloodTrack Platform.

11. TERMINATION

11.1 Termination by Tugadot

Tugadot reserves the right to suspend or terminate your access to the BloodTrack Platform at any time, with or without cause and with or without notice.

11.2 Termination by User

You may terminate your account at any time by contacting BloodTrack customer support or using the account termination features within the Platform.

11.3 Effect of Termination

Upon termination, your right to access and use the Platform will immediately cease. All provisions of these Terms and Conditions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. GOVERNING LAW AND DISPUTE RESOLUTION

12.1 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising from or relating to these Terms and Conditions or your use of the Platform shall first be attempted to be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be resolved through mediation or arbitration in Australia.

12.3 Legal Actions

Any legal action or proceeding relating to your access to or use of the BloodTrack Platform shall be instituted in courts located in Australia. You and BloodTrack agree to submit to the jurisdiction of such courts.

13. GENERAL PROVISIONS

13.1 Entire Agreement

These Terms and Conditions, together with the Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and BloodTrack regarding the Platform and supersede all prior agreements and understandings.

13.2 Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 No Waiver

The failure of BloodTrack to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms and Conditions or your rights hereunder without the prior written consent of BloodTrack. BloodTrack may assign these Terms and Conditions at any time without notice.

13.5 Force Majeure

BloodTrack shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond BloodTrack's reasonable control, including but not limited to natural disasters, pandemics, civil or military authority, acts of terrorism, or disruptions in telecommunications or internet services.
